Are nicotine pouches legal in the UK?

Pouches are legal for adults, sold under consumer safety law, and about to get their own rulebook. Here is where things stand and what is coming.

By Hektor Jonsson · Updated October 2026

Quick answer: Yes. Tobacco-free nicotine pouches are legal to buy, sell and use in the UK if you are 18 or over. They contain no tobacco, so the oral tobacco ban does not apply, and they are currently sold under general product safety rules. The Tobacco and Vapes Bill adds a formal 18+ age of sale and gives ministers powers over strength, flavours, packaging and display.

That answers the question most people are asking. The rest of this guide explains why pouches are legal when snus is not, what rules apply to them today, and what changes once the Bill is fully in force. Everything here is accurate as of October 2026. The law is moving, so check the latest status before you rely on it.

The UK banned the sale of tobacco for oral use in 1992, following an EU-wide rule. That ban covers snus, which is ground tobacco. It was kept in UK law after Brexit and still applies.

A nicotine pouch contains no tobacco. The filler is plant fibre, and the nicotine is either extracted from tobacco plants and purified or made synthetically. Either way, there is no leaf in the pouch, so it is not "tobacco for oral use" and the ban does not reach it. That one fact is the entire legal difference between the two products. Our guide to whether snus is legal in the UK covers the snus side.

How pouches are regulated right now

As of October 2026, nicotine pouches are not covered by the tobacco regulations that govern cigarettes, nor by the vape-specific rules that set a 20mg/ml limit on e-liquid. They are consumer products, so the General Product Safety Regulations apply. In practice that means:

  • the product must be safe for normal use
  • labelling must be accurate and not misleading
  • the retailer is responsible for what it sells
  • Trading Standards can act against unsafe or mislabelled products

There is no statutory maximum strength yet, which is why you can buy pouches from 1.5mg up to 50mg per pouch. There is no legal flavour restriction and no rule on where shops can display them. Specialist retailers set their own standards: every tin on this site is sold with an 18+ check, and our strength guide is there to steer people towards a sensible level rather than the top of the range.

What the Tobacco and Vapes Bill changes

The Bill has been passing through Parliament through 2025 and 2026. It is the first UK law written with nicotine pouches specifically in mind. The main provisions for pouches are:

AreaWhat the Bill does
Age of saleMakes it an offence to sell nicotine pouches to anyone under 18
StrengthGives ministers power to cap nicotine content; 20mg per pouch has been proposed
FlavoursGives ministers power to restrict flavours and flavour descriptions
PackagingGives ministers power to set packaging and labelling rules
DisplayGives ministers power to restrict in-store display and advertising
Generational banApplies to tobacco products only, not to pouches

Most of these are powers rather than fixed rules. The age of sale is written into the Bill directly. The strength cap, flavour and packaging rules will follow in regulations, and the details and timing are not final. We explain each one in what the Bill means for nicotine pouches. Do not treat any proposed figure as settled until it is in force.

What stays the same

Some things are not changing.

Pouches stay legal for adults. The Bill regulates them, it does not ban them. Anyone 18 or over will still be able to buy them.

The generational ban does not cover them. The rising age of sale that will eventually stop anyone born on or after 1 January 2009 buying tobacco applies to tobacco products. Nicotine pouches are not tobacco, so the generational rule does not apply. Our guide to the nicotine pouch age limit explains the difference.

Using pouches in public stays legal. There is no smoke, so the indoor smoking ban has never applied and nothing in the Bill changes that. Employers and venues can set their own policies, as covered in using pouches at work, in pubs and on transport.

What this means when you buy

Buy from a retailer that already does what the law is about to require. That means an age check at checkout, clear strength labelling on every product, and stock sourced through official UK distribution. The nicotine pouches hub lists every brand we carry with strength shown the same way across the range, and brands like Nordic Spirit label strength per pouch on the tin, which is the number that matters.

If a seller skips the age check, sells unlabelled tins, or offers prices far below everyone else, walk away. Our guide to spotting fake nicotine pouches explains what to look for.

Frequently asked questions

Are nicotine pouches legal in the UK in 2026?

Yes. They are legal to buy, sell and use for adults aged 18 and over. They are regulated as consumer products now, with the Tobacco and Vapes Bill adding a formal age of sale and powers over strength, flavours and packaging.

Is there a legal strength limit?

Not as of October 2026. A cap of 20mg per pouch has been proposed under the Bill but is not yet in force. Check the latest position, as this is the rule most likely to change what is on the shelf.

Can under-18s buy nicotine pouches?

Responsible retailers refuse sales to under-18s already, and the Bill makes 18 the legal age of sale. Nicotine is addictive and nobody under 18 should use pouches.

Are nicotine pouches covered by the smoking ban?

No. The indoor smoking ban covers lit tobacco. Pouches produce no smoke or vapour, so you can legally use them indoors, though venues can set their own rules.

Is it legal to sell snus in the UK?

No. Tobacco snus has been banned from sale since 1992. Tobacco-free pouches are often called snus but are a different, legal product.
